Buying property abroad, helping a parent with their banking, or managing affairs in Sweden while living overseas: sooner or later most people need a power of attorney. In Sweden the document is called a fullmakt, and the rules around it are both simpler and more flexible than many expect. This guide explains how a power of attorney works in Sweden, what the Swedish terms mean in English, when the document must be notarized, and how to make it valid abroad.

A power of attorney is a document in which one person, the principal, authorises another person, the agent, to act on their behalf: signing contracts, handling bank matters, selling property or representing them before authorities. The scope can be broad or narrow. A general power of attorney covers most matters, while a limited one applies to a single, defined task, such as signing one specific purchase agreement.

The legal basis is found in the Swedish Contracts Act (avtalslagen, 1915:218), which regulates how authority is granted and revoked. Swedish law does not generally require a power of attorney to be registered or notarized to be valid within Sweden. In practice, however, the receiving party decides: banks, foreign authorities and notaries abroad routinely require the document to be witnessed by a Notary Public, and often legalized with an Apostille, before they will accept it.

What Are Common Types of Power of Attorney Sweden?

 

General and Limited Power of Attorney

The standard fullmakt can be drafted freely, with no prescribed form. It should clearly identify the principal and the agent, describe exactly what the agent may do, state the validity period, and be signed and dated. The more precisely the powers are described, the more smoothly the document will be accepted by banks, buyers and authorities.

 

Bank Power of Attorney (Bankfullmakt)

Swedish banks almost always require their own standard form rather than a privately drafted document, and many require the principal to sign at a branch or have the signature verified. If the bank power of attorney will be used from abroad, the bank may additionally ask for notarization and an Apostille.

 

Lasting Power of Attorney (Framtidsfullmakt)

Since 2017, Swedish law recognises the framtidsfullmakt under the Act on Lasting Powers of Attorney (2017:310). It takes effect in the future, if illness or impaired health means you can no longer manage your affairs. The formal requirements are stricter than for an ordinary fullmakt: it must be in writing, made by a person over 18, and signed in the simultaneous presence of two witnesses. What Are the Formal Requirements for a Valid Fullmakt?

For an ordinary power of attorney used in Sweden, the requirements are minimal. To be practically useful, the document should contain:

  • Full name and personal identity number of both principal and agent.
  • A clear description of the powers granted, ideally itemised.
  • Validity period, or a statement that it is valid until revoked.
  • Place, date and the principal’s signature.
  • Witness signatures where the receiving party requires them.

Note that Swedish law requires witnesses by statute only in special cases, for example for a framtidsfullmakt. The receiving party’s requirements are what matter in practice, so always ask them first.

 

When Does a Power of Attorney Need to Be Notarized?

Within Sweden, notarization is rarely a legal requirement, but it is frequently a practical one. You will typically need a notarized power of attorney when:

  • The document will be used abroad. Foreign notaries, courts and land registries almost always require notarization plus an Apostille.
  • A bank or financial institution requires verified signatures.
  • The matter is high value or sensitive, such as property transactions or inheritance, where the parties want independent verification of identity and signature.

How Do You Make a Swedish Power of Attorney Valid Abroad?

A notarized signature alone is usually not enough for foreign use. Most countries also require proof that the notary themselves is genuine, and that is exactly what the Apostille provides. An Apostille is a certificate under the 1961 Hague Convention that makes a Swedish document valid in more than 120 member countries without any further legalization. Revocation is normally done by taking back or destroying the document and informing the agent and any third parties who relied on it. A framtidsfullmakt, by contrast, takes effect when the principal can no longer manage their affairs and then normally remains in force for the rest of the principal’s life.
